Today I had an interesting email chain with opposing counsel she asked me if I was ordering a court reporter for Tuesday I asked her if she was and she said no it's only an arraignment. any criminal lawyer knows all criminal cases have to be recorded -so we need to put in a request to the court to record the balance of this lawsuit in a motion that way we know and everybody has to behave and it saves a lot of money for Court Reporters. They were also trying to get the judge to piggyback the order selling the house on Tuesday. So I told her "I objected to that being set on Tuesday. So she didn't set it. But the goal is clear total control quickly sell everything quickly. That's what we have to stop.

Please read 3rd DCA cited by 4th DCA as well on requisite level of proof - Just as expected Transcript shows major errors - LeWinter v. Guardianship of LeWinter606 So. 2d 387, 388 (Fla. Dist. Ct. App. 1992) At the end of a proceeding instituted by a financially dissatisfied adopted son, the trial court determined that ninety-four-year-old Louis LeWinter was incapable of fully exercising his rights to manage his property and to consent to medical treatment, §§ 744.3215(3)(d), (f), Fla. Stat. (1991), and appointed a guardian to perform those functions for him. See § 744.331(6), Fla. Stat. (1991). We reverse because there is no competent evidence to support the order.

While the trial court may, indeed must, determine the credibility and weight of the evidence, it is not empowered to create that evidence from the whole cloth.

Good morning Inger had a good talk with Kevin last night and he impressed upon me something that I didn't understand the guardianship case has to be terminated because by statute it's been illegally run even if By agreement so that knocks Slater and Derek out of the guardianship case. Then we continue the criminal case in which we can say there was no crime but gives us time and pressure to get all the information we can to charge the real criminals here. have to figure someway that at least by next week the guardianship is terminated.

From the 4th DCA - A trial court may not hold an individual in contempt of court for violating an order which does not clearly and definitely make the person aware of its command and direction. American Pioneer Casualty Ins. Co. v. Henrion, 523 So.2d 776, 777 (Fla. 4th DCA 1988) (citing Lawrence v. Lawrence, 384 So.2d 279, 280 (Fla. 4th DCA 1980)). There must be proof that the individual intended to disobey the court, which must be proven beyond a reasonable doubt. Id. (citing Florida Ventilated Awning Co. v. Dickson, 67 So.2d 218 (Fla. 1953)). Also, there must be evidence of the individual's intent to disobey the court's order, or, that he or she was guilty of such gross dereliction that the intent will be presumed. Rowe v. Wille, 415 So.2d 79, 81 (Fla. 4th DCA 1982).

This 5th DCA case Granted Prohibition as the original Petition was Voluntarily Withdrawn and a Second Petition in Same case had No Jurisdiction. Thus Prohibition Granted. So Voluntary Dismissals of Original Action in both Cases should be filed too. Katke v. Bersche 161 So. 3d 574, 575 (Fla. Dist. Ct. App. 2014) - “Prohibition is an extraordinary writ by which a superior court having appellate and supervisory jurisdiction over a lower court may prevent the lower court from exceeding its jurisdiction or usurping authority over matters not within its jurisdiction.” Citizens Prop. Ins. Corp. v. Garfinkel, 25 So.3d 62, 63 (Fla. 5th DCA 2009). In a matter where the court loses “case” jurisdiction, a writ of prohibition is the proper claim for relief. See Tobkin v. Doctors I told Maritza am looking at how to file Habeus Corpus for Dad in Bran d new case immediately and then also move to Mandatorily Disqualify Johnson in the other 3 cases. my cell is charging and can not talk for a while

It is the way to go Lynn for sure. and one of the DCA cases says there can NOT be all these "cases in a case" that Johnson is pulling I sent that one in Text the other night so yes thanks get them google searching and we will figure this out, I would try the following search "Habeus Corpus of Adult in Florida Guardianship" but watch as you will get Criminal Cases for Habeus Corupus but in NY we had specific Statute for Habeus in Civil cases like this

Inger, it's great u are talking w Slater n she wants out of the criminal case. Nolle Prosse is ok, but a C-4 motion may be better. It allows everyone to save face. Rules of criminal procedure provide a method for the defense atty to give a statemt of facts wh, if unopposed by the prosecution, DN constitute a crime requires dismissal of chgs by the judge. My latest statemt of facts need to be shorter & less confrontational. If you're pressed for time, I can draft the motion for you.
